Terms of Service

These terms are a contract between BARTIER LLC, doing business as Made by Shemar (“we,” “us”), and you. They cover themes.madebyshemar.com, checkout on madebyshemar-themes.myshopify.com, and every product or service sold through either. Payment is acceptance of this agreement. The version live at the time you pay applies to that purchase.

1. What you are buying

Each product page states what that purchase includes. You buy a license to use the product. You do not buy the copyright. Work stays the property of BARTIER LLC unless a listing says otherwise.

A theme purchase includes the downloadable theme zip for that listing.

A theme purchase does not include:

• Install, setup, content entry, or custom code unless you buy that separately
• Shopify subscription, apps, domains, or other third-party fees
• Ongoing maintenance, updates, or free support
• SMS, email, or ads setup

2. Theme license

One theme license is one live Shopify store at a time, plus that store’s own previews and development themes. Upload the zip in Shopify Admin: Online Store → Themes → Add theme → Upload zip. You may edit the theme on that store.

The license is non-transferable. A second live store needs another license. Extra store is $99. Contact bartier.nyc.

You may not:

• Run the theme on more than one live store without another license
• Resell, sublicense, share, or redistribute it, paid or free
• Claim authorship
• Use it to build a competing theme product

3. Other products

Digital goods other than themes follow the same rules unless the listing says something different: license, not copyright; one use as described on the product page; no resale or redistribution.

Paid services (install, setup, extra store, hourly work) are only what that order describes. Anything else is a new paid job. We may decline work. If we decline before work starts, we refund that service fee.

4. Delivery

Theme and other digital downloads are delivered through /account after the email one-time passcode. After purchase you bind one myshopify domain. That domain and a unique fingerprint are stamped into the file. There is no remote kill switch.

Paid services start after payment and after you give the access and assets we ask for. Delivery dates are as agreed for that job.

5. Your responsibilities

You are responsible for your Shopify store, collaborator access, and the files you send us. You warrant that you own or have the right to use that content. We are not responsible for copyright claims on what you provide.

6. As is

Digital products are sold as is, without warranty. There is no free support after the file is available to download. Paid help is available through bartier.nyc.

7. Refunds

Digital goods: no refund after download.

Paid services:

• Full refund if work has not started
• No refund for completed, delivered, or approved work
• No refund for change of mind after work starts

8. Chargebacks

Contact us before you open a payment dispute. A chargeback on delivered work ends any remaining help on that order. We will contest the dispute with the order record.

9. Results

We do not guarantee sales, traffic, conversion, or any business result. That depends on your product, pricing, content, and marketing.

10. Third-party costs

Shopify fees, apps, domains, and other third-party charges are yours. They are not included in any product or service unless the listing says they are.

11. Communication

Use the contact on this site or bartier.nyc. Requests in other channels are not a promise of work.

12. Portfolio

For paid custom work, we may show the result in our portfolio and marketing unless you ask us in writing not to before delivery.

13. Agreement

These terms take effect when you pay. If one part cannot be enforced, the rest still applies. We may update these terms for future purchases.
